Notice for California Residents

CCPA/CPRA notice: which categories of personal information gears.games collects, what we do with them, that we do not sell them, and how California residents can exercise their rights.

Scope of this notice

This notice applies to residents of California and supplements the Privacy Policy. It describes the categories of personal information we collected in the last 12 months, their sources, the purposes and your rights under the California Consumer Privacy Act (CCPA) as amended by the CPRA.

In this notice "sell" means exchanging personal information for money or other valuable consideration, and "share" means disclosing it for cross-context behavioural advertising. We do neither.

Categories of personal information we collect

The categories below follow the definitions of the CCPA. We collect only what an order, its delivery and support require.

  • Identifiers: name, e-mail address, Telegram username, phone number, IP address, console identifier (PSN ID / Xbox Gamertag).
  • Customer records: the same contact details together with the order history and payment confirmations. Card numbers never reach us.
  • Commercial information: games and access types purchased, amounts, discounts, order statuses.
  • Internet or network activity: pages you open on the Site, request time, browser and device details in server logs.
  • What we do not collect: biometric data, precise geolocation, sensory or health data, education records and advertising inferences.

Access data issued to you (account login, password, activation code) is kept as part of the order record so that we can honour the warranty.

We do not collect "sensitive personal information" as defined by the CPRA and we do not use personal information to infer characteristics about you.

Where the data comes from

Almost all personal information comes directly from you or is created while you use the Site.

  • From you: registration, the checkout form, your profile, support chats.
  • From your device: IP address, browser, device and request logs.
  • From your payment provider: confirmation that the payment arrived, without card or wallet details.
  • From our own records: order events, delivery and audit logs.

Why we collect and use it

The purposes are limited to running the store and are described in detail in the Privacy Policy.

  • Taking, paying, reserving and delivering orders.
  • Support, warranty replacement and refunds.
  • Security of the store and fraud prevention.
  • Accounting and other legal obligations.
  • Aggregated statistics that help improve the catalogue.

Disclosure, sale and sharing

We disclose the categories above only to service providers bound by contract: hosting, payment providers and support tooling, plus authorities on a lawful request.

We do not sell personal information, we do not share it for cross-context behavioural advertising and we do not use it for targeted advertising. In the last 12 months we have not sold or shared personal information of California residents.

We do not knowingly collect or sell the personal information of consumers under 16 years of age; the service is not intended for them.

Your California rights

California residents have the rights listed below. They cover your personal information and that of your household, and we do not discriminate against you for using them.

  • Right to know: which categories and specific pieces of personal information we collected, from which sources, for which purposes and to whom we disclosed them.
  • Right to delete: ask us to delete personal information we collected from you, subject to legal exceptions.
  • Right to correct: fix inaccurate personal information.
  • Right to opt out of sale or sharing: we neither sell nor share, so there is nothing to opt out of, but we honour a Global Privacy Control signal as a formal opt-out.
  • Right to limit the use of sensitive personal information: we do not collect it.
  • Right to non-discrimination: we will not refuse service, charge a different price or deliver a lower quality of service because you exercised your rights.
  • Right to use an authorised agent: an agent may submit a request on your behalf with your written permission.

How to submit a request

Send your request to support@gears.games with the subject "CCPA request" or to Telegram @weskars. Say what you want: access, a copy, correction, deletion or an opt-out.

  • State your full name and the e-mail address of the account.
  • Add the numbers of your orders: it speeds up the search.
  • If an authorised agent writes for you, attach the written permission signed by you.

We confirm receipt within 10 business days. A request to know, correct or delete is answered within 45 calendar days; if more time is needed, we explain why and take up to 90 days in total. A deletion request is fulfilled by deleting the data and instructing our service providers to do the same.

To protect customers we verify every request: you must write from the e-mail address of the account, and for deletion we may ask you to confirm control of that address. Data we must keep by law (accounting, fraud prevention, legal claims) is excluded from deletion, and we explain why.

Financial incentives

We do not offer financial incentives, price differences or loyalty programmes in exchange for personal information. Promo codes are available to all customers on the same published terms.

Minors

The store sells digital games for Xbox and is not intended for persons under 16. We do not knowingly collect personal information from consumers under 16, and we would not sell or share it in any case.

If you are a parent or guardian and believe a child has given us personal information, write to support@gears.games: we will delete the account and the data, or explain which records we must keep.

Changes to this notice

We update this notice when our practices or the law change. The current version is always published on this page with its last-updated date.
